For the avoidance of doubt, Customer’s instructions for the Processing of Personal Data shall comply with Data Protection Laws and Regulations. Customer shall have sole responsibility for the accuracy, quality, and legality of Personal Data and how Customer acquired Personal Data. Customer specifically acknowledges and agrees that its use of the Services will not violate the rights of any Data Subject, including those that have opted-out from sales or other disclosures of Personal Data to the extent applicable under Data Protection Laws and Regulations. Handlemyfinances.com™ Processing of Personal Data. Handlemyfinances.com™ shall treat Personal Data as Confidential Information and shall Process Personal Data on behalf of and only in accordance with Customer’s documented instructions for the following purposes: (i) Processing in accordance with the Agreement and applicable Order Form(s); (ii) Processing initiated by Users in their use of the Services; and (iii) Processing to comply with other documented reasonable instructions provided by Customer (e.g., via email) where such instructions are consistent with the terms of the Agreement. 2.3. Details of the Processing. The subject-matter of Processing of Personal Data by Handlemyfinances.com™ is the performance of the Services pursuant to the Agreement. The duration of the Processing, the nature and purpose of the Processing, the types of Personal Data and categories of Data Subjects Processed under this DPA are further specified in the Data Protection Policy in this DPA. 2.4. Customer Instructions. Handlemyfinances.com™ shall inform Customer immediately (i) if, in its opinion, an instruction from Customer constitutes a breach of the GDPR and/or (ii) if Handlemyfinances.com™ is unable to follow Customer’s instructions for the Processing of Personal Data.
DATA PROTECTION POLICY
It is a continuing condition of your use of our Website Platform and Client Portal that you agree and consent to Info- Tech, as well as our representatives and/or agents, collecting, using and disclosing and sharing amongst ourselves your personal data, and disclosing such personal data to our authorized service providers and relevant third parties in accordance with the terms of our data protection policy as amended from time to time, available at https://handlemyfinances.com/privacy-policy ("Privacy Policy"), the terms of which are also incorporated into this Agreement by reference and apply to your use of our Website and all its content including the Client Private Portal. To process your services inquiry and to ensure our services are rendered efficiently and meet your requirements we need to use the information you provide such as name, address, any special needs requirements etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass on the information to the various relevant agencies such as the Internal Revenue Service State and Local Government Agencies, as well as Payroll Providers and Cloud Management Software’s as necessary. The information may also be provided to social security agencies or credit checking companies, public authorities such as customs or immigration if required by them, or as required by law. Additionally, controls of data protection in Africa may not be as strong as the legal requirements in this country. We will not however, pass any information to any person not responsible for any part of the accounting or tax services provided to you by MNS Services LLC or its Partners.
DATA INTEGRITY AND PURPOSE LIMITATION
Consistent with the Principles, personal information must be limited to the information that is relevant for the purposes of processing. An organization may not process personal information in a way that is incompatible with the purposes for which it has been collected or subsequently authorized by the individual. To the extent necessary for those purposes, an organization must take reasonable steps to ensure that personal data is reliable for its intended use, accurate, complete, and current. An organization must adhere to the principles for as long as it retains such information. Information may be retained in a form identifying or making identifiable the individual only for as long as it serves a purpose of processing within the meaning of 5(a). This obligation does not prevent organizations from processing personal information for longer periods for the time and to the extent such processing reasonably serves the purposes of fulfilling an existing service agreement obligation to the Client. Organizations should take reasonable and appropriate measures in complying with this provision.
PUBLIC RECORD AND PUBLICLY AVAILABLE INFORMATION
An organization must apply the Principles of Security, Data Integrity and Purpose Limitation, and Recourse, Enforcement and Liability to personal data from publicly available sources. These Principles shall apply also to personal data collected from public records (i.e., those records kept by government agencies or entities at any level that are open to consultation by the public in general).
It is not necessary to apply the Notice, Choice, or Accountability for Onward Transfer Principles to public record information, if it is not combined with non-public record information, and any conditions for consultation established by the relevant jurisdiction are respected. Also, it is generally not necessary to apply the Notice, Choice, or Accountability for Onward Transfer Principles to publicly available information unless the European transferor indicates that such information is subject to restrictions that require application of those Principles by the organization for the uses it intends. Organizations will have no liability for how such information is used by those obtaining such information from published materials.
Where an organization is found to have intentionally made personal information public in contravention of the principles so that it or others may benefit from these exceptions, it will cease to qualify for the benefits of the EU-U.S. DPF. In contrast, where public record information is combined with other non-public record information (other than as specifically noted above), an organization must provide access to all such information, assuming it is not subject to other permitted exceptions.
As with public record information, it is not necessary to provide access to information that is already publicly available to the public at large, if it is not combined with non-publicly available information. Organizations that are in the business of selling publicly available information may charge the organization’s customary fee in responding to requests for access. ACCESS REQUESTS BY PUBLIC AUTHORITIES

An individual who decides to invoke this arbitration option must take the following steps prior to initiating an arbitration claim: (1) raise the claimed violation directly with the organization and afford the organization an opportunity to resolve the issue within the timeframe set forth in section (d)(i) of the Supplemental Principle on Dispute Resolution and Enforcement; (2) make use of the independent recourse mechanism under the Principles, at no cost to the individual; and (3) raise the issue through the individual’s DPA to the Department and afford the Department an opportunity to use best efforts to resolve the issue within the timeframes set forth in the Letter from the Department’s International Trade Administration, at no cost to the individual. This arbitration option may not be invoked if the individual’s same claimed violation of the principles (1) has previously been subject to binding arbitration; (2) was the subject of a final judgment entered in a court action to which the individual was a party; or (3) was previously settled by the parties. In addition, this option may not be invoked if a DPA (1) has authority under the Supplemental Principle on the Role of the Data Protection Authorities or the Supplemental Principle on Human Resources Data; or (2) has the authority to resolve the claimed violation directly with the organization. A DPA’s authority to resolve the same claim against an EU data controller does not alone preclude invocation of this arbitration option against a different legal entity not bound by the DPA authority. The Federal Arbitration Act and federal arbitration law and the laws of the state of Washington, without regard to principles of conflict of laws, will govern this Agreement and any dispute of any sort that might arise between you and us. There is no judge or jury in arbitration, and court review of an arbitration award is limited. Notwithstanding anything to the contrary in this Agreement, you, and we each agree that either party may seek injunctive or other relief in any state, federal, or national court of competent jurisdiction for any actual or alleged infringement of our or any other person or entity’s intellectual property.
You further acknowledge and agree that our rights in the services rendered are of a special, unique, extraordinary character, giving them peculiar value, the loss of which cannot be readily estimated or adequately compensated for in monetary damage.
